ELKO COUNTY, NEVADA

$5,000 fine or imprisonment for up to 6 months or both can be the penalty for being on a closed road even when not marked closed when the Forest Service Travel Plan is implemented.
The U.S. Congressional / House Natural Resources Subcommittee on National Parks, Forests, Public Lands, led by Chairman Congressman Rob Bishop (R) Utah and Nevada 2nd District Congressman Mark Amodei will conduct a field hearing in Elko, Nevada.
The field hearing will consist of testimony primarily concerning the USFS Travel Management Plans that have closed many roads and trails and have prohibited cross country travel on federally managed lands for any purpose.
The hearing will be attended by county commissioners and representatives from ten (10) western states, Wyoming, Montana, Colorado, California, Oregon, Idaho, Utah, Arizona, New Mexico and Nevada representing Recreation, Wildlife, Mining, Agriculture and all other multiple uses on federally managed public lands.
The field hearing is primarily being conducted concerning the many United States Forest Service Travel Management Plans that will and have already closed many roads, trails and cross country motorized travel within the National Forest and the many potential severe negative impacts to the cultures and economies of the regions and counties of the west. Violations of 36 CFR 261.13 are subject to a fine of up to $5,000 fine or imprisonment for up to 6 months or both (18 U.S.C. 3571(e)). This prohibition applies regardless of the presence or absence of signs. This is part of what we can expect along with many other restrictions on our abilities to utilize the National Forest in Elko County.
